PAYBACK time has come in the form of a jail term for a serial rental con artist.

The ruse of Eric Heng Jit Siang was to pose as the owner of a property seeking to rent it out, milking the tenant of a deposit on the rent, and then pulling a disappearing act.

Using both landed properties and flats he had rented, the 33-year-old conned 127 people, mainly foreigners and permanent residents, out of more than $242,500 in rental deposits between last April and January.

For doing this, he was yesterday put behind bars for six years and three months.

He pleaded guilty to 40 counts of deception and three of other crimes.

The court heard that he rented 10 properties across the island, got the keys to them and then placed advertisements in newspapers and train stations seeking tenants.

When people responded to his advertisements, he posed as the owner of these properties and arranged to show them the units.

When the tenancy agreement was signed - and each unit was 'rented' out to more than one house-hunter - he collected money from each of them as a deposit on the rental or the utility bill.

The victims found out that they had been taken for a ride only when they realised on moving day that they were not the only ones who had 'rented' the place.

This was Heng's cue to make himself scarce.

Mr Amit Gurung, a 26-year-old graduate student at a private school, told The Straits Times yesterday that he paid Heng $2,800 to rent a flat in Ang Mo Kio Avenue 5 last August.

Everything seemed plausible then. The Nepalese said: 'He introduced me to his wife and daughter. He said he wanted to rent out the flat because they were going to stay with his mother as she was ill.'

Three weeks later, as he was cleaning the unit before moving in, he had visits by no fewer than six people, all claiming to have rented the flat from Heng. They had the keys too.

Unable to reach Heng on his cellphone, Mr Gurung went to the police.

Deputy Public Prosecutor Andre Moses Tan pushed for a deterrent sentence, saying the offences were 'deliberate' and not committed in 'a moment of folly'.

In sentencing, District Judge Eddy Tham reprimanded Heng: 'What you have done is despicable. It has caused a lot of anxieties to these people.'

Heng, jobless at the time of his offences, was also fined $600 for driving without a valid driving licence.

He was arrested in February after having been on the run since last year.

None of the victims has got his money back. Mr Gurung said he is not banking on it.

No official data on rental scams exists, but the Consumers Association of Singapore said it has handled a steadily rising number of cases involving rental disputes, including misleading claims or misrepresentation.

The figures were 123 in 2006, 177 in 2007 and 231 last year. There have been 57 cases so far this year.

Last December, a Malaysian couple and a Japanese expatriate apparently lost $10,300 in all to a bogus property manager-cum-landlord of a terrace house in Serangoon.

Two agents from property agency ERA were apparently also duped by the man. It is not known whether he is still in hiding.

With the rentals increasing and no respite from rental-increments in sight for better and reasonably prices houses, there are bound to be cheatings and frauds and I encountered with such an accident and would like to share it with you. I would request you to spread this to as many people as you can so that people like us are not cheated/trapped into conspiracies created by owners/agents who are trying to take advantage of the screwed up demand-supply situation of Rental houses in Singapore.

Please spend five minutes of your busy schedule, doing so may help you or your friend avoiding some hassles/falling into traps of dishonest owners/agents.

I rented out a full unit at Block 142, unit #08-10, Rivervale Crescent - 540142 in Sengkang on 7th April 2007 and finally moved into the house on 10th April with my family. I got this unit from a person called Nick ,I came to know that his real indian name was Naresh, not fully sure though, from Roof Property Pte Ltd, (This agent is a big-fraud, please beware of him. He is a tall guy, with brownish-yellow eyes and curly heir, his contact number is 90054927 ) .He posed a lady named Bibi Rehana Omar Khan (93971406,NRIC S7529328C) as the owner of this aforementioned unit.

I moved into this unit on 9th and started living in with my family from 10th April 2007. On the very first night we moved into this house, someone named Farid, a person of about 35-40 yr age, broke-into this apartment at 2:00 AM and started watching the TV at high volume. This guy was heavily drunk that was evident from his red-eyes. Disturbed by the loud noise, I opened the door of my bedroom and found this guy sitting on the sofa, smoking cigarette and watching TV. I was scared and infurious like hell. Upon enquiry, he said that the house belonged to him and that he has been released from the prison on that day and have no place to live. He claimed that the house belonged to him and I must vacate the house immediately. He tried to intimidate me by repeatedly stating that he has come from Prison and is not afraid of police, if I choose to call police.

This incidence disturbed the peace of my house and my wife also got up. I tried to reason with him but to no avail. I tried calling this lady Rehana but she did not pick up my call. Calling Nick did not help either. He was least bothered by what we were going through. After making all the attempts to amicably solve the issue at hand with the owner and agent , I gave up and was left with no choice but to argue diplomatically with this criminal. After disturbing, threatening and scaring us for about 1.5 hr, he left with another warning that he would return back at 7:00 in the morning and would break the door dare I put any pad-lock etc.

We took a day off and tried taking help from these two people named Rehana and Nick only to find that they were either not picking our calls or were just canceling our calls. We got frustrated and decided to take police action against these people and went to Sengkang NPC. It was then, when police called Rehana, I started getting all kind of calls from Rehana and Nick that they would send so many people to live in the house and that I would see what all trouble they can create for us. Police also did not help saying that Owner can send anybody to house to stay since the house was unapproved and informed that this Criminal was no-one but the Brother-in-law of this lady Rehana. And this fact made it legal for Rehana to put an ex-convict in the house.

To cut this long story short, I was forced to leave the house in one day by all kind of threats that they would trouble me, should I decide to stay. Apparently, due to my family's security's concerns, I had to leave the house immediately.

Later when I told this story to my friends, I discovered that, there were at least 4 more people cheated on 24 th march (exactly same story), 10th April (me), 7th May (this time Farid  acted as owner and Jack Sing as Agent), and later 10th May 2007
(Farid and Jack/Jat Sigh) for amounts $2700.00,$2525.00,$3100.00, $2200.00 respectively.This proved that this was a very well orchestrated drama by Rehana, the land-lady, Farid, Nick and another agent named Jat/jack-singh (name unsure).

After knowing all this, I thought that I must share this story with you so that you can take precaution when you visit any new apartment for rent. Also, I lost S$2525.00, in this whole episode and was thrown out of gear completely for at least 2 weeks. Please beware of this agent Nick/Jat(or Jack) sing and this owner Rehana/ Farid.

I had written this whole story just after my incidence and tried to send it to the yahoogroup ezlink, where about 12000 people are member, but it was blocked on this yahoo group and could not be published, so I am sending to whatever mail-ids I could find. Please help spread this story. Had this story been published on yahoogroup a gentleman on 7th May may have avoided these unfortunate event in which he lost SGD 3100.00.

For your reference, there are atleast 3 Police Reports in Sengkang NPC against this Agent/Land Lord duo and 3 HDB complaints, which are known to me. There could be several others as well. Thanks.

Landlord fined for peeping at tenant while she was bathing

  A teenaged student who was having a shower had a shock when she realised that her landlord was watching her by using a mirror he held over the bathroom door. The man, LAU Bak Lim, 37, had stood on a chair outside the bathroom and slipped the mirror through the gap between the top of the door and the ceiling. LAU, who pleaded guilty to a charge of intending to insult the modesty of his tenant, was fined S$2000 by a magistrate court on Friday 27 Oct 2000.

 

Couple cheated prospective tenants of deposits  

A couple raked in almost S$40,000 by collecting deposits for rooms they never intended to rent out. They cheated 47 people over three months by running newspaper advertisements for rooms in their rented flat, showing them to prospective tenants and demanding a deposit for holding the rooms. PHAN Quee Yew, 49, and his 39-year-old live-in girlfriend, who has also been charged, then skipped town with the deposits, which ranged from S$300 to S$2700. A district court this week sentenced PHAN to three years in jail after he pleaded guilty to 10 counts of cheating. (Straits Times 24 Nov 2000)

 

Landlady jailed for harbouring illegal immigrants

  A retired widow was jailed on 27 Nov 2000 for harbouring illegal immigrants. Paridah Sanip, 63, a former civil servant, was sentenced to six months in prison after pleading guilty to renting rooms in her home to two Indonesian women who had overstayed their social visit passes. Conman jailed for cheating

  A man conned three people into giving him a total of S$41,600 by pretending he would rent out his flat to them. Zakaria Juki, 39, never intended to rent anyone the flat. It wasn't even his to rent out. The cheat used it to collect rent deposits from would-be tenants. On 2 Jan 2001, he was jailed for two years after he admitted cheating his victims and committing a criminal breach of trust. (Straits Times 3 Jan 2001)

 

Common Scams or Cheating Cases are as follows :

 

1. One Landland leasing the same flat a couple of times at about the same time to not one but many tenants ;

 

2. Somebody including but not limited to tenants of Common or Master Room or Agents OR any human beings not the REAL LANDLORD who is in possession of the main door key post as REAL LANDLORD to lease the flat out to tenants and/or collect Deposit and Rental from Potential Tenants  and issues receipt on behalf of Landlord but do not have the right to lease out the HDB Flat.

 

To minimise risk, try to issue cheque instead of paying in cash, in the name of the Landlord, after verification from documents produced by Agent such as Latest Property Tax Search on the Said Unit. Take copy of the identification such as NRIC/Passport of the person who is receiving the cash or cheque from you. If a receipt is issued, ensure that it is from a Good Company not a simple receipt where you can get it for say less than S$3/- from many Stationery Shops/Companies.

 

 

 

 

 

HELPING TENANTS TO LOOK FOR LONG TERM ACCOMMODATION IN SINGAPORE

 

The Information below is a guide to assist tenants who are looking for HDB/Condo Long Term Accommodation for their stay in Singapore.

 

General Current Rental Market Prices ( Subject to change like weather )

 

HDB 1 +1  between S$1,000 to S$1,200 per month (Rare, Unauthorised for Low Income families)

HDB 2 +1  between S$1,400 to S$1,800 per month (If unfurnished, it may be as low as S$1,200)

HDB 3 +1 (4 Room type) / (5 Room type) between S$1,800 to S$2,000 per month

HDB EA or EM Executive Apartments/Mansionette  S$2,000 onwards

HUDC (Old Large Flat Housing formerly for government officials now converted into Apartments) S$2,000 onwards

 

Apartments/Condo about S$2,100 and above. Now in Early July 2009 rental market is about S$2,100.

 

Rental rates depend on many factors, such as location, furnished, partly furnished, near MRT, authorized, unauthorised and others. Generally places in Woodlands, Marsiling, Yishun and Bukit Panjang may be a little cheaper.

 

Authorised HDB Flat - usually this is price higher than the unauthorised as there is some form of other expenses incurred monthly by the Landlords and the Landlords must be physically living and working abroad. These are definitely fewer than expected and are in great demand by many expatriates in Singapore. There is definitely not enough to meet the growing demands by expatriates in Singapore. The chances of one getting an Authorised Whole Unit HDB Flat are slim.

 

Unauthorised HDB Flat - are common and easily available but definitely cheaper as compared to authorised HDB Flat as they avoid paying the necessary monthly taxes from the Rental Income collected from Tenants to HDB.

 

The Famous or Infamous Local Version of  "The Locked Room" which may be Authorised by HDB but the Landlord must physically occupy "The Locked Room"  but usually they do not as they want to get a higher rent from Tenants for privacy. If possible, one should try to avoid such tenancy but due to limited supply of Authorised HDB Flats for RENT one usually succumbs to such tenancy.

 

What this "Locked Room" means is that you get the Master Room or any other Room plus the hall space at a much higher Rental Rate as compared to common or master room rental but Rental Rate appear quite close to taking the Whole Unit by yourself.

 

The Landlord must physically resides in the Locked Room but due to privacy reasons and getting a higher rental as a result of these they are prepared not to reside in the Locked Room.

 

Misleading and Wrongly Used Words

Master Bedroom with Attached Toilet in Condo/Apartments or HDB wrongly called as Studio Apartments. Surely, there is No privacy.

 

Common Bedroom With Shared Toilet/Kitchen/Washing Machine in Condo/Apartments or HDB wrongly called as Apartment/Hotel Alternatives or Studios and there are many versions of many types of these. Just Beware and Be Alert.

 

 

 

Standard Agency Fees / Commission which Tenants have to bear.

 

A 1 Year HDB Tenancy or Less - 1/2 month Agency Fee

A 2 Years HDB Tenancy  - 1 month Agency Fee 

 

Avoid unreliable Agents and Check ownership of HDB Units first (Documents to prove ownership of Unit such as property tax and others) before releasing deposit and or rental to them.

 

Please DO NOT sign any Commission or Legal Documents without even reading through it. If in doubt, consult a friend or ask your Human Resources/Admin/Senior Staff about it.

 

REMEMBER to start with a lower budget than what you can afford then if you find the rental reasonable and you view an apartment you really like it then you can slowly increase the amount for rental.

Renting a room in Singapore? Read this first!

 

Rooms in private apartments, landed houses and public housing flats (HDB) are available for rent in Singapore.

     However, foreigners wishing to rent such rooms are to take note of the following:

 

1. Owners of property need to see your employment pass, work permit or student pass before they will rent out their rooms. The laws in Singapore are very strict with regard to harbouring of illegal immigrants. Owners of flats, apartments or landed houses face mandatory jail and caning for not instituting proper checks on immigration status of foreigners renting rooms from them. In the case of public Housing Board (HDB) flats, such flats are confiscated.

 

2. Some owners may not allow cooking to be carried out. But, generally, the rooms are rented out with the following:

          a. access to bathroom/toilet

          b. access to common areas in the premises, such as living room, kitchen and dining areas

          c. access to utilities, such as water and electricity (included in rent)

          d. access to the television set in the living room

          e. access to laundry facilities, such as washing machine (self-wash)

          f.  access into the premises up to midnight (Some owners do not like their tenants to come home late - clarify this point before you commit)

          g. rooms are lockable - but owner usually keeps a spare set of keys

 

3. A deposit of one month's rent is payable upfront, together with the first month's rent

 

4. One month's notice is usually required from owner and tenant to terminate the arrangement

 

5. Usually, there is no written agreement

 

6. If the advertiser is a real estate agent, and shows you the place, you will have to pay him/her a commission equivalent to one month's rent. To reduce cost, respond to ads from owners only

 

7. Try to make sure the person you meet is authorised to rent out the room to you. There have been cases in which dubious characters have got away with accepting cash deposits from would-be tenants and it was later found out that these characters were not the owners of the premises. Such

characters would usually rent the premises from the real owner and pay by using a post-dated cheque. Within the next two days before the cheque is cleared, they place ads in the papers to rent out the premises, then collect cash deposits from unsuspecting would-be tenants and disappear. 

So politely check out the owner's status by asking him/her for a current utilities (PUB) account statement or property tax bill and his/her identity card (NRIC). Match the name on the statement with the name on the identity card. Every Singaporean carries an identity card. The utilities and Property tax statements will usually show the owner's name  

 

8. If you rent a room in an HDB flat, bear in mind that such flats are located in the heartlands. You may not see any expatriate for miles. You will only get to meet Singaporeans and perhaps some workers from neighbouring countries, such as Malaysia and China. Also, the neighbourhood food centres offer mainly local fare. Western food may be available at some coffeeshops or food centres

Amendments to the Immigration Act

"..anyone who assists the landlord in the renting of his premises to an immigration offender in return for any reward, is presumed to have assisted, encouraged or induced the landlord to provide shelter to the immigration offender.

Such a middleman will need to also conduct the 3 due diligence checks when they help the landlords to rent out their premises to foreign tenants.

Those convicted will be liable to mandatory imprisonment of 6 months to two years as well as a fine not exceeding $6,000.

 

 

Range of prices for Room Rental for HDB/Condo and etc depending on location and convenience to MRT and others. Prices vary depending on whether there is Air condition, Utilities and or Internet are included. Usually there is no formal agreement on room rental.
